1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Oz Systems Pty Ltd (ABN 31 605 616 671) ("Company," "we," "us," or "our") concerning your access to and use of the CalmHealthyMind website and application (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you:

• Are at least 18 years of age
• Have the legal capacity to enter into these Terms
• Will comply with these Terms and all applicable laws and regulations
• Have not been previously suspended or removed from the Service

3. Description of Service

CalmHealthyMind is a digital wellness platform offering:

• A structured 28-week personal development program
• AI-powered coaching and personalized guidance
• Progress tracking and journaling tools
• Habit tracking and wellness resources
• Community features and support materials

Important: The Service is for informational and educational purposes only. It is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

4.2 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we deem harmful to the Service or other users.

5. Subscriptions and Payments

5.1 Subscription Plans

The Service offers various subscription tiers with different features and pricing. Current pricing is available on our website and may be updated from time to time.

5.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is processed through our third-party payment processor (Stripe)
• You authorize us to charge your payment method for all fees owed
• Prices are in Australian Dollars (AUD) unless otherwise stated
• All fees are non-refundable except as required by law or stated in our Refund Policy

5.3 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings.

5.4 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price increases. Your continued use of the Service after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree NOT to:

• Violate the intellectual property rights of others
• Upload viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the Service or other user accounts

You retain ownership of content you create through the Service (journal entries, reflections, etc.). By using the Service, you grant us a limited license to use, store, and display your content solely to provide the Service to you.

7.3 License to Use Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our privacy practices.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, OZ SYSTEMS PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

These Terms are governed by the laws of Australia and the State/Territory where Oz Systems Pty Ltd is registered, without regard to conflict of law principles.

13.2 Dispute Resolution

Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us at admin@ozsystems.com.au. We will attempt to resolve the dispute informally within 60 days.

13.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Australia for the resolution of any disputes.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Sending you an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
